These Terms and Conditions apply to the JelloPoint website and JelloPoint software products and services.

By downloading, purchasing or using a JelloPoint product, you agree to these Terms and Conditions.

1. About JelloPoint

2. JelloPoint Products

JelloPoint provides WordPress plugins and related software and services.

Products may be offered as free or paid versions. Features available in each version may change as our products are further developed.

We reserve the right to improve, modify, add or remove features where reasonably necessary for the continued development of our products.

3. Software Licences

Paid JelloPoint products are provided under a software licence.

The number of websites on which a paid product may be activated depends on the licence purchased.

A valid active licence is required to receive software updates and support.

You may not resell, redistribute or provide access to a paid JelloPoint product or licence key as a standalone product unless explicitly permitted by us.

Any open-source components included in our software remain subject to their respective open-source licences.

4. Purchases and Payments

Purchases, subscriptions, licence management and payments for JelloPoint products are handled through Freemius and its payment providers.

Prices and applicable taxes are displayed during checkout before you complete your purchase.

By completing a purchase, you also agree to any applicable checkout, payment and licensing terms presented by Freemius.

5. Subscriptions and Renewals

Where a JelloPoint licence is sold as a subscription, it may automatically renew at the end of the applicable billing period unless cancelled before the renewal date.

You can manage or cancel your subscription through the account or subscription management options provided with your purchase.

Cancelling a subscription prevents future renewals but does not terminate the licence period that has already been paid for.

If a subscription expires, the Pro features already installed on your website will continue to work. However, you will no longer receive software updates or technical support until the subscription is renewed.

This means you can continue using the installed version of the Pro software after your subscription expires, but compatibility with future versions of WordPress, PHP or third-party software cannot be guaranteed without updates.

6. Refunds

Refund requests for paid JelloPoint products are handled in accordance with the refund policy presented during purchase and the applicable policies of Freemius.

Where mandatory consumer protection laws provide additional rights, those statutory rights remain unaffected.

7. Updates

We aim to maintain compatibility with current versions of WordPress and other software explicitly supported by the product.

However, we cannot guarantee compatibility with every WordPress theme, plugin, hosting environment, PHP version or third-party service.

Updates may change, improve, replace or discontinue functionality where reasonably necessary for security, compatibility or continued product development.

Software updates are available only while you have an active eligible licence or subscription.

8. Support

Technical support for paid products is provided while you have an eligible active licence or subscription.

Support covers JelloPoint products themselves. We cannot guarantee support for problems caused by third-party plugins, themes, hosting configurations, custom code or modifications to our software.

After a subscription expires, technical support is no longer included. Renewing the subscription restores access to support and available software updates.

9. User Responsibilities

You are responsible for maintaining appropriate backups of your website and data before installing or updating JelloPoint software.

You are also responsible for ensuring that your use of JelloPoint products complies with applicable laws and regulations.

You must not use our products or services for unlawful purposes or attempt to interfere with, damage or gain unauthorised access to our systems, licensing services or website.

10. Intellectual Property

The JelloPoint name, branding, website content, documentation, graphics and other original materials are owned by OnlineNow or their respective licensors and may not be reproduced or used without permission except where permitted by law.

Software components distributed under an open-source licence remain governed by that licence.

11. Availability and Warranty

JelloPoint products are provided on an “as is” and “as available” basis to the extent permitted by applicable law.

We aim to provide reliable and well-maintained software, but we cannot guarantee that our products will always operate without errors, interruptions or compatibility issues.

Nothing in these Terms excludes warranties or other rights that cannot legally be excluded under applicable consumer protection law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, OnlineNow shall not be liable for indirect or consequential losses resulting from the installation, use or inability to use a JelloPoint product.

This may include loss of data, revenue, business opportunities or website availability.

You are responsible for maintaining adequate website and database backups.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

13. Third-Party Services

JelloPoint products may integrate with or depend on third-party software or services, including WordPress, Elementor, Freemius and other platforms.

We are not responsible for changes, interruptions or discontinuation of third-party products or services that are outside our control.

14. Termination

We may suspend or terminate access to licences, support or services in cases of fraud, abuse, unauthorised distribution, licence misuse or material violation of these Terms.

This does not affect any statutory rights you may have under applicable law.

15. Changes to These Terms

We may update these Terms and Conditions to reflect changes to our products, services, business practices or legal requirements.

The latest version will always be published on this website.

16. Governing Law

These Terms and Conditions are governed by the laws of France, subject to any mandatory consumer protection rights that may apply in your country of residence.

Any disputes shall be handled by the competent courts in accordance with applicable law.
